Quebec benefits from a distinct immigration framework within Canada, with greater autonomy than other provinces, particularly in terms of its policies and procedures. As a result, Quebec offers a simplified LMIA process to facilitate the hiring of foreign workers in certain sectors. This process allows Quebec employers to recruit more easily, without having to follow all the usual steps involved in applying for an LMIA in other provinces.
The Simplified LMIA process follows a similar format to the Classic LMIA, but with a few notable differences:
Language of application: LMIA applications for Quebec must be written in French, except for live-in caregiver jobs. The government is working to help employers overcome this language requirement.
Job advertising: Unlike in other provinces, Quebec employers do not need to prove that they have attempted to recruit a Canadian citizen or permanent resident before hiring a foreign worker.
Eligible occupations: This simplified process is reserved for occupations experiencing high demand or labour shortages in the region where the employer is located.
Joint submission: Applications must be approved by both federal (ESDC) and provincial (Ministère de l'Immigration, de la Francisation et de l'Intégration - MIFI) authorities. This requires simultaneous submission to both organizations.
To be eligible for the simplified LMIA, employers must ensure that the proposed position is on the list of occupations in demand for their region of Quebec. This list varies according to the specific needs of the job market in each sector.
